Terms of Service — 3D Bits App

3D Bits - Terms of Service

These Terms of Service ("Terms") govern your use of the 3D Bits application ("App") provided by MB "Bit by bit developers", a limited liability company registered in Lithuania (Volungės g. 5-1, Vilnius LT-10315) ("we", "us", "Company"). By checking the acceptance box and using the App, you ("Merchant", "you") agree to these Terms.

These Terms supplement - and do not replace - the Shopify Terms of Service, the Shopify App Developer Terms, and any agreements between you and Shopify. If there is a conflict between these Terms and Shopify's terms regarding the Shopify platform itself, Shopify's terms prevail for matters within Shopify's control.


1. What 3D Bits Does

3D Bits is a Shopify app that enables merchants to add interactive 3D product viewers, parametric configurators, and visual programming-driven 3D experiences to their Shopify storefronts. You create these experiences in the App's built-in editors, save them as projects, and publish them to your products. On the storefront, the App renders 3D content through its theme app extension - an app embed that you enable once for your whole store, or blocks that you place on specific templates - which loads the Bitbybit Runner (a JavaScript bundle) in your customers' browsers. Some configurators can also calculate prices from your customers' selections and apply them at checkout - see Section 4.

Relationship Between You, Us, and Shopify

  • We are solely responsible for the App. The App is developed and maintained by MB "Bit by bit developers", not by Shopify.
  • Shopify is not liable for any fault in the App or any harm that may result from its installation or use.
  • Shopify cannot provide assistance with the installation, configuration, or use of the App, except where expressly stated by Shopify.
  • We are solely responsible for any liability that may arise from your access to or use of the App, including its development, marketing, distribution, and your access to or use of any Merchant Data through the App.

What this means

We built 3D Bits, we maintain it, and we're the ones responsible for it - not Shopify. If you ever need help with the App, we're the right people to talk to.

2. Your Subscription

Access to the App requires an active paid subscription (Base, Standard, or Pro) purchased through Shopify's billing system. Subscription management, billing, refunds, and payment processing are handled entirely by Shopify under Shopify's terms. We do not process payments directly.

If your subscription lapses or is cancelled, the App's functionality will be disabled, and 3D features will no longer render on your storefront.

Non-Exclusive Service

We reserve the right to provide the App and related services - including but not limited to support, consulting, and custom development - to your competitors and make no promise of exclusivity. Your use of the App does not create any exclusive arrangement between you and us, and we will not use your Confidential Information (as described in our Privacy Policy) in doing so.


What this means

You pay through Shopify, not us directly. If your subscription ends, 3D content will stop showing on your store - but you can re-subscribe anytime to get it back.

3D Bits is a standard SaaS app available to all Shopify merchants - including ones that might sell similar products to yours. At this price point, exclusivity simply isn't something we can offer. That said, your specific 3D configurations, scripts, and assets are yours alone - we never share one merchant's work with another.

3. How the App Uses Your Store

When you use the App, the following happens on your Shopify store:

  • A Theme App Extension renders 3D content on your product pages - either as an app embed you enable once in your theme settings, or as blocks you place on specific product templates.
  • Metafield definitions and values are created on your products to store 3D configuration data (model URLs, scene configurations, inline scripts, display and pricing settings) in the 3d_bits namespace, and, when you use configurator pricing, checkout pricing rules in the bitbybit_pricing namespace. Helper products the App generates also carry an seo namespace metafield that keeps them out of storefront search results.
  • App Data Metafields are created on the App's own installation to record which subscription tier is active. Your theme reads them to decide which 3D Bits blocks you are offered, so blocks belonging to a plan you are not on do not appear in the theme editor. They hold the tier only - no personal data.
  • Hidden helper products are created in your catalogue when you use configurator pricing. Depending on the charging method you choose, the App creates products carrying the vendor name "3D Bits Fee" - one per priced option group, a "price units" product, and a $0 product that carries customer file uploads - so that a configured price can be collected through ordinary Shopify cart lines. With the variant-matrix method, the App instead generates variants on your own product, replacing its existing variants. These products and variants appear in your catalogue, exports, and reports. When an option is removed or a project is retired, the App archives them rather than deleting them, because past orders reference them - deleting them would break your order history. The App can also offer to exclude them from your automated collections.
  • Files are created in your store's Content → Files section (Shopify CDN) when you upload assets through the App or publish a project - published project artifacts are stored as files in your own store. Re-publishing a project replaces its previously published artifact file, and deleting a project in the App removes its published artifact files and clears its product metafields.
  • Theme information is read (never modified) to check whether the app embed is enabled and to locate existing 3D Bits blocks.
  • JavaScript files (the Bitbybit Runner and orchestrator scripts) are loaded in your customers' browsers when they visit product pages where 3D Bits is enabled.

We recommend testing that the App works correctly with your specific Shopify theme before going live. We do our best to ensure broad compatibility, but we cannot guarantee it with every theme, custom code, or other installed apps.

Third-Party Integrations and Product Variants

To enable product variant selection (e.g., size, color, material), 3D Bits integrates with Shopify's standard variant system and may also integrate with third-party variant or product options apps. These integrations work by reading variant selectors, option inputs, and other DOM elements from your storefront.

Breaking changes are outside our control. If Shopify, your theme, or any third-party app changes its HTML structure, CSS class names, element IDs, JavaScript APIs, or other interfaces that 3D Bits relies on, your configurators may stop working correctly. This includes but is not limited to:

  • Shopify theme updates that change the product form structure or variant selector markup.
  • Third-party apps that update their option selectors, naming conventions, or JavaScript behavior.
  • Shopify platform changes to the variant system, metafield API, or theme app extension framework.
  • Changes to your theme's custom code or Liquid templates.

We are not responsible for breakages caused by changes made by Shopify, theme developers, or third-party app developers. We know this can be frustrating - we're happy to help you adapt. Here's what you can do:

  • Monitor your storefront after theme or app updates to verify that 3D configurators continue to work.
  • Test changes in a development or staging environment before publishing to your live store.
  • Contact us if you need help adapting your configuration to updated interfaces.

We make reasonable efforts to maintain compatibility with widely used themes and apps, but we cannot guarantee uninterrupted operation when external dependencies change.


What this means

The App adds an embed or blocks to your theme, stores configuration data on your products, saves your uploaded files and published projects into your own store's Files section, and loads JavaScript in your customers' browsers. If you turn on configurator pricing, it also creates some hidden helper products in your catalogue (vendor "3D Bits Fee") so the configured price can be charged through normal Shopify cart lines - or, with the variant-matrix method, generates variants on your own product. You'll see them in your product list and exports. Please don't delete them by hand: past orders point at them, so the App archives rather than deletes them when they're no longer used. If Shopify, your theme, or another app updates and changes the page structure, your 3D configurators might need adjusting - that's not something we can prevent, but we're here to help if it happens. It's a good idea to test after updates.

4. Pricing, Configurators, and Checkout Charges

Some 3D Bits configurators can calculate a price from the options your customer selects (for example base price, per-option amounts, formulas, included products, and quantity) and turn that price into a real charge at checkout. This section applies whenever you enable configurator pricing.

Configurator pricing is optional. You do not have to use it. You can run 3D Bits purely as a 3D viewer or visual configurator and handle pricing through Shopify's native product and variant pricing, or through a third-party pricing or product-options app. If you price your products another way, leave 3D Bits configurator pricing disabled - while it is off, 3D Bits does not calculate prices or add, remove, or change any amount at checkout, and the remainder of this section does not apply to those products.

You define and own your pricing. You set the base prices, option amounts, formulas, included products, linked products, and the charging method for each project. You are solely responsible for the correctness of your pricing rules and of every amount charged to your customers, including applicable taxes, duties, and legal price-display and consumer-protection obligations in each market where you sell.

The displayed price is an estimate; Shopify determines the amount charged. The price shown in the configurator is calculated in your customer's browser for display and convenience. The authoritative amount your customer pays is calculated and charged through standard Shopify constructs (product variants, cart lines, and Shopify checkout functions) on Shopify's infrastructure. We are not a payment processor, tax engine, or merchant of record; we do not hold or move funds.

You must test your configurations before selling. Configurator pricing produces many possible outcomes - every combination of options, quantities, and (if you sell internationally) currencies and markets can produce a different result. It is your responsibility to test the relevant combinations end to end, placing real test orders where appropriate, before going live, and again whenever you change your prices, products, theme, markets, or the App updates. Where a change affects a product that a configurator charges through - in particular a change to its price, or its removal from your catalogue - republish the project so that what your customers see and what checkout collects are based on the same figures.

Multiple currencies and Shopify Markets. You author prices in your store's base currency. When you sell in other currencies or markets, amounts may be converted or adjusted by Shopify, and in some configurations the charged amount may differ slightly from the estimate shown, or from a simple conversion, because of currency conversion, rounding, and per-market pricing rules. Where exact per-market pricing matters, we recommend the charging methods best suited to international selling (as indicated in the App) and testing each market. We do not guarantee that configured prices are exact in every currency or market.

Some purchase flows are not fully supported. Configurator pricing is designed for the standard flow, where the customer adds the configured product to the cart and then checks out. It may not apply to, or may behave differently with, subscription or selling-plan purchases; accelerated or express checkout buttons that let a customer buy directly from a product page without going through the cart (for example Shopify's dynamic checkout buttons such as Shop Pay, Apple Pay, Google Pay, or PayPal); and other non-standard or third-party checkout flows. For products that use configurator pricing, we recommend testing these flows and turning off any express or dynamic checkout buttons that would let a customer bypass the configured price. You are responsible for the amount charged when a purchase is made through an unsupported flow; do not rely on configured pricing for those flows.

Review your configured orders before you fulfil them. The App provides an order review screen that re-checks each configured order against the pricing rules it was sold under and flags anything it could not confirm. Checking configured orders there before you fulfil or ship them is part of using configurator pricing, in the same way that testing your configurations is, and it is your responsibility rather than ours. We do not verify, monitor, or act on your orders for you.

Protecting against incorrect charges. To reduce the risk of a customer being charged an incorrect amount, the App is designed to prevent an order from completing when it cannot confirm the price is correct. As a result, a checkout may occasionally be blocked - for example when a configuration is out of date or a required setup step is incomplete - and the customer is asked to reconfigure. Keeping your projects, products, and App setup current reduces this. We do not guarantee that every configuration will always complete checkout, and we are not responsible for sales affected by such protective blocking or by your configuration.


What this means

Using our pricing is completely optional - you can keep pricing in Shopify's own tools or a third-party app and simply leave 3D Bits pricing turned off, in which case this section doesn't apply to those products. If you do use configurator pricing, you set the prices and you're responsible for making sure they're right - including taxes and the prices your customers actually pay. The price shown on screen is an estimate; the real charge is calculated by Shopify at checkout, not by us (we never touch the money). Because every option, quantity, and currency combination can change the result, please test your configurations before going live and after any change. If you change the price of a product one of your configurators charges through, or remove it from your catalogue, republish that project so the price on screen and the price at checkout agree again. Selling internationally? Amounts in other currencies can round or shift a little - test each market. A few flows aren't fully supported - subscriptions, and express or one-tap checkout buttons that skip the cart (like Shop Pay, Apple Pay, Google Pay, or PayPal); for products where you use our pricing, test these and consider turning those quick-buy buttons off so nobody can skip the configured price. Before you fulfil a configured order, check it on the order review screen - it re-checks each one against the rules it was sold under and tells you what it couldn't confirm. That check is yours to run; we don't watch your orders for you. Finally, to protect you and your customers, the App would rather block a checkout than charge a wrong amount, so occasionally a shopper may be asked to reconfigure. We can't promise every setup always checks out perfectly, which is why testing matters.

5. Assets and Content

Your Responsibility for Assets

You are solely responsible for all assets (3D models, textures, images, scripts, configurations) that you upload, create, or use through the App. You represent and warrant that:

  • You own or have all necessary rights, licenses, and permissions to use every asset in your store.
  • Your assets do not infringe the intellectual property rights of any third party.
  • Your assets comply with all applicable laws and Shopify's Acceptable Use Policy.

Assets Are Public

Important: Assets used by 3D Bits on your storefront - including 3D model files, textures, scripts, and configuration data - are served to your customers' browsers and are therefore publicly accessible. Anyone visiting your store can download these assets using standard browser developer tools. This is inherent to how web-based 3D rendering works and is not a limitation specific to 3D Bits.

Do not use assets that contain trade secrets, confidential information, or material you do not want to be publicly downloadable.

Assets Hosted on Shopify CDN

Assets you upload through Shopify (product images, files attached to metafields) are hosted on Shopify's infrastructure under Shopify's terms. We have no control over Shopify's CDN availability, caching behavior, or file retention policies.

Shopify CDN Processing. Shopify may process, re-encode, or transform files you upload to its CDN - including images and 3D model files (glTF/GLB). This processing is performed entirely by Shopify and is outside our control. As a result:

  • Invalid or unsupported files - If your glTF/GLB files are malformed, use unsupported compression methods (e.g., certain Draco or meshopt configurations), or contain non-standard extensions, Shopify's processing may reject, alter, or corrupt them. 3D Bits cannot override or bypass Shopify's file processing pipeline.
  • Visual differences - The rendering engine used by 3D Bits may display 3D models differently than Shopify's built-in 3D viewer. Differences in lighting, materials, shading, color space handling, and geometry interpretation are expected and are not a defect.
  • File size and format limitations - Shopify imposes its own file size limits and supported format restrictions on uploaded assets. Files that exceed these limits or use unsupported formats cannot be hosted on Shopify's CDN. Consult Shopify's documentation for current limits.

Alternative hosting. If Shopify's CDN processing causes issues with your 3D assets, you may host those assets on your own infrastructure or a third-party CDN and reference them via URL in your product metafields. Contact us at info@bitbybit.dev if you need guidance on alternative hosting configurations.

Customer-Uploaded Content and Share Links

If you enable file-upload controls in your configurator, your customers can upload images or other permitted files while configuring a product. These uploads exist to fulfill personalized orders: they drive on-product personalization features (for example, image decals rendered onto the 3D product) and are typically necessary for you to manufacture the customized product the customer ordered. When a customer adds a configured product to the cart, uploaded files are stored as files on your store through Shopify's standard cart upload mechanism and hosted on Shopify's infrastructure under Shopify's terms.

  • Customer uploads are treated as your assets for the purposes of this Section 5, Section 12 (Indemnification), and Section 13 (Prohibited Uses). As between you and us, you are responsible for monitoring and moderating content your customers upload to your store, and for removing content that is unlawful, infringing, or in violation of Shopify's Acceptable Use Policy. You can remove uploaded files at any time in Shopify Admin (Content > Files); a removed file stops resolving in previously shared links.
  • Share and reopen links. The App can generate links that reopen a saved configuration. A configuration link including uploaded files is always attached to the order as a hidden property visible only to you. Whether the customer-facing share link also includes uploaded images is controlled by a setting that is OFF by default; if you enable it, customers can distribute links that display their uploaded content on your product page to anyone who opens the link.
  • No pre-screening; removal is in your hands. The App does not review, moderate, or filter customer uploads, and - because uploads are stored on your store, not on our systems - we have no technical ability to access or remove them. Removing content is done by you in Shopify Admin, or by Shopify under its own policy enforcement. What we may do, where we believe in good faith that it is required by law or Shopify policy, is disable or limit the App's upload- and share-related features.

Performance and Asset Size

3D rendering performance depends heavily on the size and complexity of the assets you use. Large 3D model files, high-polygon meshes, and high-resolution textures (e.g., 4K or above) significantly increase loading times and memory consumption, and may cause poor performance or rendering failures on lower-powered devices such as mobile phones, tablets, and older computers.

It is your responsibility to optimize your 3D assets for web delivery. We do not guarantee that the App will perform well with assets of any arbitrary size or complexity. If you use large or unoptimized assets, the resulting customer experience - including slow load times, visual glitches, or browser crashes - may be affected. We recommend keeping assets optimized for the best results.


What this means

Your 3D models, textures, and scripts are your responsibility - make sure you have the rights to use them. One thing to keep in mind: anything displayed in the browser can technically be downloaded by visitors, so avoid putting sensitive or confidential material in your 3D assets. When you upload files to Shopify, Shopify may process them in ways that can affect certain 3D formats. If your models look wrong or won't load, try hosting them elsewhere - we're happy to help with guidance, and can also offer hosting services at additional cost. Also, 3D Bits may show things slightly differently than Shopify's own 3D viewer - that's expected, not a bug. For the best customer experience, we recommend optimizing your 3D models for the web - large files and heavy textures can slow things down, especially on phones. If you let customers upload images (say, for engravings or printed decals), those images live on your store because you usually need them to actually produce the personalized item. Keep an eye on what gets uploaded - only you can delete the files (anytime in Shopify Admin, we can't touch them), and by default customer share links don't include uploaded images (you'd have to switch that on).

6. Bitbybit CDN and Self-Hosting

The App loads the Bitbybit Runner and supporting assets (WebAssembly binaries, Web Workers, fonts) from the Bitbybit CDN (git-cdn.bitbybit.dev). These assets are essential for 3D rendering on your storefront.

Best-Effort Availability. The Bitbybit CDN is delivered through industry-leading, globally distributed CDN infrastructure with edge caching and high-performance delivery. We use commercially reasonable efforts to maintain high availability, but we do not guarantee any specific level of uptime or performance. CDN outages, network disruptions, third-party infrastructure issues, version deprecations, or maintenance may temporarily prevent 3D content from rendering on your store. We acknowledge that any loss of connectivity to these static assets may negatively affect the merchant and customer experience on your storefront.

Self-Hosting Option. If you prefer full control over asset delivery, the App supports custom CDN URLs - you can host the Bitbybit Runner files on any CDN or infrastructure of your choice. For production stores where 3D availability is business-critical, this gives you independence from our infrastructure decisions. Asset packages are available for download from Bitbybit Assets Releases. See the Self-Hosting Guide and the 3D Bits CDN Settings for details.

Your Responsibility. If you choose to self-host, you take on responsibility for the availability, security, and correct configuration of your hosted assets. We're happy to point you in the right direction, but we cannot provide ongoing support or warranty for self-hosted deployments.


What this means

The Bitbybit Runner (our JavaScript library with the 3D engine, CAD algorithms, and WebAssembly assets) is loaded from our CDN, which runs on trusted, globally distributed infrastructure. Your 3D files themselves live on Shopify's CDN under Shopify's own terms. We can't guarantee 100% uptime, but we've chosen infrastructure we trust to deliver fast, reliable performance. If you'd rather not depend on our CDN, you can host the Runner files yourself on any CDN you prefer - we provide downloadable packages and a simple setting for custom URLs.

7. Bitbybit Runner

The 3D rendering on your storefront is powered by the Bitbybit Runner, which is governed by the Bitbybit Runner License (explained in detail on our Runner Licensing page). The Runner contains both open-source components (governed by their respective licenses - see the NOTICE file) and proprietary components. You may not reverse-engineer, decompile, or extract the proprietary components of the Runner.

App Updates and Runner Versions

App updates are automatic. When we release updates to the 3D Bits application (the admin interface, editors, and backend), they are applied automatically. The Viewer Editor and other editors within the App always use the latest available version of the Runner.

Runner versions on your storefront are locked by design. The Runner version used by the app embed and by each of your Theme App Extension blocks is set when you configure them and does not change automatically. The app embed and different product templates may use different Runner versions. This is intentional - it ensures backwards compatibility so that your existing configurators continue to function exactly as you set them up, even as newer Runner versions are released.

You are responsible for updating Runner versions. When you are ready to take advantage of new rendering capabilities, performance improvements, or bug fixes in newer Runner versions, you must update the Runner version in the app embed settings and in each of your product templates individually. We recommend testing updated Runner versions in a development or staging environment before applying them to your live store, as changes to the underlying rendering engine or algorithms may affect how your existing configurations behave.

Critical updates. In rare cases involving critical security vulnerabilities or issues that could cause data loss or significant harm, we reserve the right to automatically update Runner versions across all storefronts. We will notify you if such an update occurs and explain the reason.


What this means

The 3D engine has its own license. It includes open-source parts (which you can use freely) and proprietary parts (which you must not reverse-engineer). You can read the full details on our licensing page. One important thing: the App itself updates automatically, but the Runner version on your storefront stays locked to what you chose for each template - different templates can even run different versions. This keeps your existing 3D setups working reliably. When you're ready for the latest features, you update each template yourself. We recommend testing first, as updates usually work smoothly but it's always good to double-check. In the unlikely event of a critical security issue, we may push an update automatically - but we'll let you know if that happens.

8. Data and Privacy

Our data practices for the 3D Bits app are described in our 3D Bits Privacy Policy.

In summary:

  • We collect and store your Shopify store domain, merchant email, and subscription status for app functionality.
  • When you use the App's projects, we store your project content on our servers: project names and settings, work-in-progress drafts, published version history (scene configurations and scripts), and records of the assets you upload (file names and links). The asset files themselves are stored in your own store on Shopify's CDN, not on our servers.
  • 3D rendering happens entirely in your customers' browsers - no customer data is sent to our servers.
  • The App's order review screen reads the line items and amounts of your recent orders from Shopify, on demand, only while you are viewing that screen, so it can re-check what configured orders collected. It reads no customer fields - no names, addresses, contact details, or payment information - and stores nothing about your orders on our servers.

Operational Communications

We may send you emails regarding important service-related matters, including security notices, Runner version deprecations, breaking changes, scheduled maintenance, and critical updates affecting your store's 3D functionality. These communications are necessary for the operation of the App and are not marketing. You will receive these as long as you have the App installed.


What this means

We only store what's needed for the App to work - your shop domain, subscription info, and the 3D projects you create in the App (so your work is saved and versioned between sessions). The files you upload live in your own store's Files section, not on our servers. All 3D rendering happens right in their browser, and nothing is sent to our servers. When you open the order review screen, we read your recent orders' line items and amounts from Shopify just to re-check what configured orders collected - we don't read customer names, addresses or payment details, and we don't keep any of it. We may email you about important things like security issues or breaking changes - but never marketing. These are strictly operational messages to help you keep your store running smoothly.

9. Intellectual Property

Our Intellectual Property

The App, including its source code, design, algorithms, compiled bundles, documentation, and branding, is the intellectual property of MB "Bit by bit developers". Your subscription grants you a limited, non-exclusive, non-transferable right to use the App for your Shopify store. You may not copy, modify, reverse-engineer, or create derivative works based on the App.

Your Intellectual Property

You retain all rights to the assets, 3D models, configurations, and content you create or upload through the App, subject to the asset publicity described in Section 4.


What this means

The App is ours, your content is yours. We don't claim any rights to what you create.

10. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The App will be uninterrupted, error-free, or compatible with your theme, other apps, or custom code.
  • 3D content will render correctly on all devices, browsers, or network conditions.
  • The Bitbybit CDN will be available at all times.
  • CAD operations, geometry processing, or 3D rendering results will be accurate, complete, or suitable for any particular purpose.
  • Configurator pricing calculations, the composition of cart charges, or the amounts charged to your customers will be accurate, complete, or correct for every product, option, quantity, currency, market, or discount combination.

Visual discrepancies between rendered 3D models and physical products are inherent to 3D rendering technology and do not constitute a defect in the App. We do not guarantee that 3D representations will accurately reflect real-world product characteristics including color, size, texture, or material properties. It is your responsibility to verify that 3D representations on your store are not misleading to your customers.


What this means

We work hard to make the App reliable, but we can't promise it will be perfect in every situation, on every device, or with every theme. 3D on the web involves many variables beyond our control. If your 3D model doesn't look exactly like the physical product, that's an inherent limitation of rendering technology, not a defect in the App - but it's worth checking that your 3D views aren't misleading to customers.

11. Limitation of Liability

In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, goodwill, or revenue, or any amounts overcharged, undercharged, refunded, or charged back to your customers, arising out of or in connection with your use of the App, even if advised of the possibility of such damages.

Our total aggregate liability for all claims arising from or related to the App shall not exceed the total subscription fees paid by you through Shopify for the App during the six (6) months immediately preceding the event giving rise to the claim.

This limitation applies to all causes of action in the aggregate, including but not limited to breach of contract, breach of warranty, negligence, strict liability, misrepresentations, and other torts.


What this means

This is standard for software services. If something goes wrong, the most we could owe you is what you paid us in the last 6 months. We're not liable for indirect losses like missed sales. This protects both of us and keeps pricing fair.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the App and any assets or content you upload, create, or display through the App.
  • Your violation of these Terms, any applicable law, or any third-party rights (including intellectual property rights).
  • Claims by your customers arising from 3D content displayed on your storefront (including product misrepresentation, inaccurate configurators, or misleading visualizations).
  • Your failure to comply with applicable consumer protection, product representation, or advertising laws in your jurisdiction.
  • Amounts charged to, or refunded or charged back by, your customers in connection with configurator pricing, and any related tax, consumer-protection, or price-display obligations.

What this means

If a legal claim arises because of content on your store or how you use the App, you're responsible for handling it. This is standard for app agreements and covers things like IP disputes over your assets or customer complaints about product representations.

13. Prohibited Uses

You may not:

  • Use the App to display content that is illegal, fraudulent, misleading, defamatory, or harmful.
  • Use 3D configurators to mislead customers about product capabilities, dimensions, materials, or appearance in ways that constitute fraudulent advertising.
  • Attempt to reverse-engineer, decompile, or extract proprietary components of the App or the Bitbybit Runner.
  • Use the App in a manner that intentionally or recklessly overloads shared infrastructure, such as automated mass requests, bot traffic, or deliberate abuse of API endpoints.
  • Resell, sublicense, or provide access to the App to third parties.
  • Circumvent subscription restrictions, plan limitations, or feature gates.

What this means

Please use the App responsibly - don't use it for anything illegal, misleading, or harmful, and don't try to reverse-engineer it or resell access.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and display a notice in the App requiring you to re-accept the updated Terms before continuing to use the App. Your continued use of the App after accepting updated Terms constitutes your agreement to the changes.


What this means

If we update these Terms, you'll see a clear notice in the App and will need to agree before continuing. We won't change things silently.

15. Termination

You may stop using the App at any time by uninstalling it from your Shopify store. Upon uninstallation, your access to the App features will end, but metafield data created by the App may remain on your products until you manually remove it.

Suspension and Termination by Us

If you violate these Terms, we will notify you of the violation and provide a fourteen (14) day cure period to resolve the issue. For the following serious violations, we may suspend or terminate access immediately:

  • Use of the App for illegal, fraudulent, or harmful purposes.
  • Reverse-engineering, decompilation, or extraction of proprietary components.
  • Reselling, sublicensing, or providing unauthorized third-party access.

If immediate suspension is necessary, we will notify you as soon as practicable and explain the reason.

While we have no plans to discontinue the App and are actively developing it, we reserve the right to discontinue the App or terminate access for operational or business reasons by providing at least thirty (30) days' prior notice.

Refunds on Termination

If you cancel your subscription or uninstall the App, subscription fees already paid are non-refundable.

If we terminate your access due to serious violations listed above, no refund is owed.

If we terminate your access for any other reason - including App discontinuation - you are entitled to a pro-rata refund of any pre-paid subscription fees for the unused portion of your billing period.

Data Deletion

Upon uninstallation, we immediately delete your session data and terms acceptance records from our systems. Your project content (projects, version history, and asset records) is kept for a short grace window: Shopify sends us a shop data erasure request approximately 48 hours after uninstallation, and upon receiving it we permanently delete all remaining data associated with your store from our database, including your projects and their version history. If you reinstall the App before the erasure request arrives, your projects are preserved.

Data stored in your own Shopify store is not deleted by us and remains under your control: metafield data on your products and files in your store's Content → Files section (including uploaded assets and published project artifacts). Remove these yourself if you no longer want them.

Reinstallation

If your product metafields, assets on Shopify's CDN, and configured theme app extension blocks or app embed remain intact after uninstallation, reinstalling the App may restore your published 3D experiences without reconfiguration, because they render from data stored in your own store. In-app projects and version history, however, are permanently deleted once the data erasure described above completes and cannot be restored by reinstalling. We also cannot guarantee that reinstallation will fully restore previous functionality, as Shopify platform changes, theme updates, or other factors may affect compatibility. If you delete your metafield data, remove assets from Shopify's CDN, or remove the theme app extension blocks before reinstalling, that content cannot be recovered by the App.


What this means

You can leave any time by uninstalling. If there's a Terms violation, we'll let you know and give you 14 days to fix it - immediate removal is reserved for serious issues like fraud or reverse-engineering. If we terminate your access for non-serious reasons, you'll get a refund for the unused portion of your subscription. After you uninstall, we delete your login data right away, and your projects follow about 48 hours later when Shopify tells us to erase your store's data - so if you change your mind and reinstall within that window, your projects are still there. Anything stored in your own store (product metafields and uploaded files) stays put until you remove it, which is why your published 3D experiences can come back after a reinstall - but projects erased after the grace window are gone for good.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of laws provisions.

Jurisdiction

Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Vilnius, Republic of Lithuania.

Dispute Resolution

Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least thirty (30) days from written notice of the dispute. If the dispute cannot be resolved through negotiation, either party may pursue legal remedies in the courts specified above.


What this means

Lithuanian law applies. If there's ever a disagreement, we'll try to work it out directly first - and we'll take at least 30 days to do so before anyone considers legal action.

17. General Provisions

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our 3D Bits Privacy Policy and the Bitbybit Runner License, constitute the entire agreement between you and the Company regarding your use of the App. They supersede all prior or contemporaneous communications, proposals, and representations with respect to the App.

Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond the party's reasonable control, including but not limited to natural disasters, acts of government, pandemic, war, terrorism, riots, embargoes, fire, floods, power outages, internet or telecommunications failures, or third-party infrastructure outages.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.

Waiver

The failure of either party to enforce any provision of these Terms shall not constitute a waiver of that party's right to enforce that provision or any other provision in the future.


What this means

Standard legal housekeeping: if one clause is struck down, the rest still holds; this document plus our Privacy Policy and Runner License is the whole agreement; neither of us is liable for things truly beyond our control (like natural disasters or internet outages); and not enforcing a rule once doesn't mean we've given it up.
